3. Kategorier af personoplysninger

Hvis relevant for det projekt hvori du deltager, behandler vi følgende personoplysninger om dig: 

Almindelige personoplysninger:

• Navn, adresse, e-mailadresse og mobiltelefonnummer.

Almindelige personoplysninger af fortrolig karakter:

• Cpr.nr
• Lønsedler, timeregistreringer, arbejdsbeskrivelse, ansættelseskontrakt og eventuelle tillæg hertil, hvis udgifterne til din   løn medtages i et projektregnskab til Erhvervsstyrelsen.
• Tilknytning til arbejdsmarkedet, herunder ledighed og uddannelsesniveau, hvis du er deltager i et projekt under Socialfonden Plus eller Fonden for Retfærdig Omstilling.

Følsomme personoplysninger:

• Helbredsoplysninger, hvis du deltager i et projekt under Socialfonden Plus, prioritet 1, indsats 3, eller prioritet 4 i det nationale program for Socialfonden Plus.

4. Formålene med og retsgrundlaget for behandlingen af dine personoplysninger 

Vi indsamler og behandler dine personoplysninger til brug for behandlingen, gennemførelsen, kontrollen, evalueringen og effektmålingen af det strukturfondsprojekt, du deltager i.
 
Retsgrundlaget for vores behandling af dine personoplysninger følger af:

• Bekendtgørelse nr. 285 af 1. marts 2022 om støtteberettigelse, regnskab, revision og kontrol m.v. i forbindelse med udbetaling af tilskud fra Den Europæiske Regionalfond, Den Europæiske Socialfond Plus og Fonden for Retfærdig Omstilling § 16, stk. 6, nr. 5.
• Europa-Parlamentets og Rådets Forordning (EU) Nr. 2021/1060 af 24. juni 2021 artikel 74, stk. 1, litra a.
• Europa-Parlamentets og Rådets Forordning (EU) Nr. 2021/1057 af 24. juni 2021 om oprettelse af Den Europæiske Socialfond Plus (ESF+) og om ophævelse af forordning (EU) nr. 1296/2013, bilag I.
• Europa-Parlamentets og Rådets Forordning (EU) 2016/679 af 27. april 2016 om beskyttelse af fysiske personer i forbindelse med behandling af personoplysninger og om fri udveksling af sådanne oplysninger og om ophævelse af direktiv 95/46/EF (generel forordning om databeskyttelse) artikel 6, stk. 1, litra c for så vidt angår almindelige personoplysninger, og artikel 9, stk. 2, litra f og g vedrørende følsomme personoplysninger.
• Lovbekendtgørelse nr. 433 af 22. april 2014 (forvaltningsloven) § 28, stk. 2, nr. 3 for så vidt angår fortrolige oplysninger.
• Lovbekendtgørelse nr. 289 af 8. marts 2024 om supplerende bestemmelser til forordning om beskyttelse af fysiske personer i forbindelse med behandling af personoplysninger og om fri udveksling af sådanne oplysninger (databeskyttelsesloven) § 11, stk. 1, for så vidt angår behandlingen af personnummer.

5. Modtagere eller kategorier af modtagere 

Vi kan videregive eller overlade dine personoplysninger til følgende modtagere: 

Erhvervsstyrelsen, Rigsrevisionen, EU-Kommissionen, Den Europæiske Revisionsret, European Anti-Fraud Office, øvrige Erhvervshuse, andre offentlige myndigheder samt Erhvervsstyrelsens databehandlere. 

6. Hvor stammer dine personoplysninger fra?

Hvis din arbejdsgiver er økonomisk partner i et strukturfondsprojekt, som Erhvervsstyrelsen har bevilget os et tilskud til at gennemføre, får Erhvervshus Fyn dine personoplysninger fra dig selv eller din arbejdsgiver.

7. Opbevaring af dine personoplysninger

Vi opbevarer dine personoplysninger så længe at reglerne knyttet til det konkrete strukturfondsprojekt foreskriver dette.

Er der tale om et strukturfondsprojekt hvori der indgår statsstøtte, kan oplysningerne påkræves opbevaret i op til 20 år fra projektstart, alt afhængig af opstartsår. Er der derimod tale om et strukturfondsprojekt hvori der ikke indgår statsstøtte, skal oplysningerne opbevares i 5,5 år efter Erhvervsstyrelsens sidste slutudbetaling til projektet.

8. Dine rettigheder 

Du har efter Databeskyttelsesforordningen en række rettigheder i forhold til vores behandling af oplysninger om dig. Hvis du vil gøre brug af dine rettigheder, skal du kontakte os. 

Ret til at se oplysninger (indsigtsret):

• Du har ret til at få indsigt i de oplysninger, som vi behandler om dig, samt en række yderligere oplysninger. 

Ret til berigtigelse (rettelse):

• Du har ret til at få urigtige oplysninger om dig selv rettet. 

Ret til sletning:

• I særlige tilfælde har du ret til at få slettet oplysninger om dig, inden tidspunktet for vores almindelige sletning indtræffer. 

Ret til begrænsning af behandling: 

• Du har i visse tilfælde ret til at få behandlingen af dine personoplysninger begrænset. Hvis du har ret til at få begrænset behandlingen, må vi fremover kun behandle oplysningerne – bortset fra opbevaring – med dit samtykke, eller med henblik på at retskrav kan fastlægges, gøres gældende eller forsvares, eller for at beskytte en person eller vigtige samfundsinteresser. 

Ret til indsigelse:

• Du har i visse tilfælde ret til at gøre indsigelse mod vores behandling af dine personoplysninger. Du kan læse mere om dine rettigheder i Datatilsynets vejledning om de registreredes rettigheder, som du finder på www.datatilsynet.dk. 

Ret til at transmittere oplysninger (dataportabilitet): 

• Du har i visse tilfælde ret til at modtage dine persondata i et struktureret, almindeligt anvendt og maskinlæsbart format samt at få overført disse persondata fra én dataansvarlig til en anden uden hindring. 

9. Klage til Datatilsynet

Du har ret til at indgive en klage til Datatilsynet, hvis du er utilfreds med den måde, vi behandler dine personoplysninger på. Du finder Datatilsynets kontaktoplysninger på www.datatilsynet.dk.

3. Categories of personal data 
If relevant to the project in which you participate, we process the following personal data about you:  

General personal data:

• Name, address, email address and mobile phone number.  

General personal data of a confidential nature:

• Cpr.nr
• Payslips, time registrations, work descriptions, employment contract and any supplements to these if the expenses for your salary are included in a project account for the Danish Business Authority.
• Attachment to the labour market, including unemployment and level of education, if you are participating in a project under the Social Fund Plus or the Just Transition Fund.  

Sensitive personal data:

• Health information if you are participating in a project under the Social Fund Plus, Priority 1, Action 3, or Priority 4 of the National Social Fund Plus Programme.

4. The purposes and legal basis for the processing of your personal data  
We collect and process your personal data for the purpose of the processing, implementation, control, evaluation and impact measurement of the Structural Funds project in which you are participating.  

The legal basis for our processing of your personal data follows from:

• Executive Order no. 285 of 1 March 2022 on eligibility, accounting, auditing and control, etc. in connection with the payment of grants from the European Regional Development Fund, the European Social Fund Plus and the Just Transition Fund, section 16(6)(5).
• Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021, Article 74(1)(a).
• Regulation (EU) 2021/1057 of the European Parliament and of the Council of 24 June 2021 establishing the European Social Fund Plus (ESF+) and repealing Regulation (EU) No 1296/2013, Annex I. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), Article 6(1)(c) with regard to general personal data, and Article 9(2), points (f) and (g) concerning sensitive personal data.
• Consolidated Act no. 433 of 22 April 2014 (the Public Administration Act) section 28(2)(3) with regard to confidential information.
• Consolidated Act no. 289 of 8 March 2024 on supplementary provisions to the Regulation on the protection of natural persons in connection with the processing of personal data and on the free movement of such data (the Data Protection Act) section 11(1) with regard to the processing of personal identity numbers.

5. Recipients or categories of recipients  
We may pass on or hand over your personal data to the following recipients:  
 
The Danish Business Authority, the Danish National Audit Office, the European Commission, the European Court of Auditors, the European Anti-Fraud Office, other business houses, other public authorities and the Danish Business Authority's data processors.   

6. Where does your personal data come from?  
If your employer is a financial partner in a structural fund project that the Danish Business Authority has granted us a grant to implement, Erhvervshus Fyn receives your personal data from yourself or your employer.   

7. Storage of your personal data 
We store your personal data for as long as the rules related to the specific structural fund project prescribe this.   

In the case of a Structural Funds project involving state aid, the information may be required to be stored for up to 20 years from the start of the project, depending on the start-up year. If, on the other hand, it is a Structural Fund project that does not include state aid, the information must be stored for 5.5 years after the Danish Business Authority's last final payment to the project.

8. Your rights  
According to the General Data Protection Regulation, you have a number of rights in relation to our processing of information about you. If you want to exercise your rights, please contact us.  
 
Right to see information (right of access):

• You have the right to access the information we process about you, as well as a number of additional information.  

Right to rectification (rectification):

• You have the right to have incorrect information about yourself corrected.  

Right to erasure:

• In special cases, you have the right to have information about you deleted before the time of our ordinary deletion occurs.  

Right to restriction of processing:

• In certain cases, you have the right to have the processing of your personal data restricted. If you have the right to have the processing restricted, we may in future only process the data – except for storage – with your consent, or for the purpose of establishing, exercising or defending legal claims, or for the protection of a person or important public interests.  

Right to object:

• In certain cases, you have the right to object to our processing of your personal data. You can read more about your rights in the Danish Data Protection Agency's guidance on the rights of data subjects, which you can find on www.datatilsynet.dk.  

Right to transmit information (data portability):

• In certain cases, you have the right to receive your personal data in a structured, commonly used and machine-readable format and to have this personal data transferred from one data controller to another without hindrance.  

9. Complaint to the Data Protection Authority 
You have the right to lodge a complaint with the Danish Data Protection Agency if you are dissatisfied with the way we process your personal data. You can find the Danish Data Protection Agency's contact information on www.datatilsynet.dk.
