I forbindelse med din deltagelse i et af Erhvervshusets projekter, skal vi oplyse dig om følgende i henhold til databeskyttelsesforordningen 

1. Vi er den dataansvarlige – hvordan kontakter du os? 

Erhvervshus Fyn er dataansvarlig for behandlingen af de personoplysninger, vi har modtaget om dig i forbindelse med din deltagelse i et af vores programmer. Vores kontaktoplysninger er:

3. Kategorier af oplysninger

Hvis relevant for det projekt hvori du deltager, behandler vi følgende personoplysninger om dig:

Almindelige personoplysninger:

• Navn, adresse, e-mailadresse og mobiltelefonnummer.

Almindelige oplysninger af fortrolig karakter:

• Cpr.nr.
• Lønsedler, timeregistreringer, arbejdsbeskrivelser, ansættelseskontrakt og eventuelle tillæg hertil, hvis udgifterne til din løn medtages i et projektregnskab til Erhvervsstyrelsen.

4. Formålene med og retsgrundlaget for behandlingen af dine personoplysninger 

Vi indsamler og behandler dine personoplysninger til brug for behandlingen, gennemførelsen, kontrollen, evalueringen og effektmålingen af det projekt, du er tilknyttet.

Det retslige grundlag for at behandle oplysninger om dig afhænger af, hvilket projekt, du deltager i. Retsgrundlaget for vores behandling af dine personoplysninger følger således af:

• Europa-Parlamentets og Rådets Forordning (EU) 2016/679 af 27. april 2016 om beskyttelse af fysiske personer i forbindelse med behandling af personoplysninger og om fri udveksling af sådanne oplysninger og om ophævelse af direktiv 95/46/EF (generel forordning om databeskyttelse) artikel 6, stk. 1, litra b, hvis det er nødvendigt for os af hensyn til den aftaleindgåelse der er knyttet til, at du deltager i et projekt, som Erhvervshus Fyn administrerer, artikel 6, stk. 1, litra c i det tilfælde, der er tale om retlige forpligtelser pålagt i det projekt, du deltager i eller artikel 6, stk. 1, litra e i det tilfælde, der er tale om opgaver i projektet, der henfører til offentlig myndighedsudøvelse som led i håndteringen af det projekt, du deltager i.
• Lovbekendtgørelse nr. 433 af 22. april 2014 (forvaltningsloven) § 28, stk. 2, nr. 3 for så vidt angår fortrolige oplysninger.
• Lovbekendtgørelse nr. 289 af 8. marts 2024 om supplerende bestemmelser til forordning om beskyttelse af fysiske personer i forbindelse med behandling af personoplysninger og om fri udveksling af sådanne oplysninger (databeskyttelsesloven) § 11, stk. 1, for så vidt angår behandlingen af personnummer.

5. Modtagere eller kategorier af modtagere

Vi kan videregive eller overlade dine personoplysninger til følgende modtagere: 

• Erhvervsstyrelsen, Rigsrevisionen, EU-Kommissionen, Den Europæiske Revisionsret, European Anti-Fraud Office, andre offentlige myndigheder samt Erhvervsstyrelsens databehandlere. 
• Hvis finansieringen af det projekt du deltager i kommer fra andre private eller offentlige fonde og organisationer kan vi også videregive dine oplysninger hertil. 

6. Hvor stammer dine personoplysninger fra? 

Hvis din arbejdsgiver deltager i et projekt, får Erhvervshus Fyn dine personoplysninger fra din arbejdsgiver eller dig selv.

7. Opbevaring af dine personoplysninger 

Registreringen opbevares i minimum 5 år efter forløbets afslutning, afhængig af reglerne knyttet til det konkrete projekt, du deltager i. Herefter anonymiseres persondata, medmindre andre forløb forhindrer det. Behandling af data sker i overensstemmelse med gældende lovgivning.

8. Dine rettigheder 

Du har efter Databeskyttelsesforordningen en række rettigheder i forhold til vores behandling af oplysninger om dig. Hvis du vil gøre brug af dine rettigheder, skal du kontakte os. 

Ret til at se oplysninger (indsigtsret):

• Du har ret til at få indsigt i de oplysninger, som vi behandler om dig, samt en række yderligere oplysninger. 

Ret til berigtigelse (rettelse):

• Du har ret til at få urigtige oplysninger om dig selv rettet. 

Ret til sletning:

• I særlige tilfælde har du ret til at få slettet oplysninger om dig, inden tidspunktet for vores almindelige sletning indtræffer. 

Ret til begrænsning af behandling:

• Du har i visse tilfælde ret til at få behandlingen af dine personoplysninger begrænset. Hvis du har ret til at få begrænset behandlingen, må vi fremover kun behandle oplysningerne – bortset fra opbevaring – med dit samtykke, eller med henblik på at retskrav kan fastlægges, gøres gældende eller forsvares, eller for at beskytte en person eller vigtige samfundsinteresser. 

Ret til indsigelse: 

• Du har i visse tilfælde ret til at gøre indsigelse mod vores behandling af dine personoplysninger. Du kan læse mere om dine rettigheder i Datatilsynets vejledning om de registreredes rettigheder, som du finder på www.datatilsynet.dk. 

Ret til at transmittere oplysninger (dataportabilitet) 

• Du har i visse tilfælde ret til at modtage dine persondata i et struktureret, almindeligt anvendt og maskinlæsbart format samt at få overført disse persondata fra én dataansvarlig til en anden uden hindring. 

9. Klage til Datatilsynet 

Du har ret til at indgive en klage til Datatilsynet, hvis du er utilfreds med den måde, vi behandler dine personoplysninger på. Du finder Datatilsynets kontaktoplysninger på www.datatilsynet.dk.

3. Categories of information
If relevant to the project in which you participate, we process the following personal data about you:  

General personal data: 

• Name, address, email address and mobile phone number.  

General information of a confidential nature: 

• Cpr.nr. 
• Payslips, time registrations, work descriptions, employment contract and any supplements to these if the expenses for your salary are included in a project account for the Danish Business Authority.   

4. The purposes and legal basis for the processing of your personal data  
The legal basis for processing information about you consists of the performance of Erhvervshus Fyn's public authority tasks pursuant to Article 6(1)(e) of the General Data Protection Regulation. If we register your personal identity number, the legal basis is based on section 11(1) of the Danish Data Protection Act (ensuring unique identification) and, with regard to the other confidential information, section 28(2)(3) of the Danish Public Administration Act.

Purpose: 
We collect and process your personal data for the purpose of the processing, implementation, control, evaluation and impact measurement of the project you are associated with. 

4. The purposes and legal basis for the processing of your personal data  
We collect and process your personal data for the purpose of the processing, implementation, control, evaluation and impact measurement of the project you are associated with.  

The legal basis for processing information about you depends on which project you are participating in. The legal basis for our processing of your personal data thus follows from:   

• Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Article 6(1)(b) of Directive 95/46/EC (General Data Protection Regulation), where necessary for us for the purposes of the conclusion of the contract attached, that you participate in a project administered by Erhvervshus Fyn, Article 6(1)(c) in the case of legal obligations imposed in the project in which you are participating, or Article 6(1)(e) in the case of tasks in the project that relate to the exercise of public authority as part of the management of the project, you participate in. 
• Consolidated Act no. 433 of 22 April 2014 (the Public Administration Act) section 28(2)(3) with regard to confidential information. 
• Consolidated Act no. 289 of 8 March 2024 on supplementary provisions to the Regulation on the protection of natural persons in connection with the processing of personal data and on the free movement of such data (the Data Protection Act) section 11(1) with regard to the processing of personal identity numbers.  

5. Recipients or categories of recipients  
We may pass on or hand over your personal data to the following recipients:  
 
The Danish Business Authority, the Danish National Audit Office, the European Commission, the European Court of Auditors, the European Anti-Fraud Office, other public authorities and the Danish Business Authority's data processors.  
 
If the funding for the project you are participating in comes from other private or public foundations and organisations, we may also disclose your information to them. 
 
6. Where does your personal data come from?  
If your employer participates in a project, Erhvervshus Fyn receives your personal data from your employer or yourself. 

7. Storage of your personal data  
The registration is stored for a minimum of 5 years after the end of the course, depending on the rules linked to the specific project you are participating in. After this, personal data is anonymized, unless other processes prevent it. Processing of data is done in accordance with applicable legislation.

8. Your rights  
According to the General Data Protection Regulation, you have a number of rights in relation to our processing of information about you. If you want to exercise your rights, please contact us.  

Right to see information (right of access):

• You have the right to access the information we process about you, as well as a number of additional information.  

Right to rectification (rectification):

• You have the right to have incorrect information about yourself corrected.  

Right to erasure:

• In special cases, you have the right to have information about you deleted before the time of our ordinary deletion occurs.  

Right to restriction of processing:  

• In certain cases, you have the right to have the processing of your personal data restricted. If you have the right to have the processing restricted, we may in future only process the data – except for storage – with your consent, or for the purpose of establishing, exercising or defending legal claims, or for the protection of a person or important public interests.  

Right to object:

• In certain cases, you have the right to object to our processing of your personal data. You can read more about your rights in the Danish Data Protection Agency's guidance on the rights of data subjects, which you can find on www.datatilsynet.dk.  

Right to transmit information (data portability):  

• In certain cases, you have the right to receive your personal data in a structured, commonly used and machine-readable format and to have this personal data transferred from one data controller to another without hindrance.  

9. Complaint to the Data Protection Authority 
You have the right to lodge a complaint with the Danish Data Protection Agency if you are dissatisfied with the way we process your personal data. You can find the Danish Data Protection Agency's contact information on www.datatilsynet.dk.
